Terms, Conditions and Privacy Policy

By using this website and/or by booking accommodation at our Retreat, Holiday Let, The Old Coach House you agree to the following Terms, Conditions and Privacy Policy.

1. Contracting Entities.

The booking agreement that you will entry into is between you and Yew Tree Counselling Limited, (trading as YTC), Glasgow, Scotland and is subject to Scottish Law and the exclusive jurisdiction of the Scottish courts.

2. Booking & Payment

When you submit a booking via our website you will receive a summary by email to the email address you provide in the booking form. The prices shown in the invoice will include applicable discounts. This does not form a contract between us. A contract agreement shall only arise when your deposit payment has cleared, and your booking is subsequently confirmed in writing by email.

When you book The Old Coach House, you agree to pay 50%, of the booking fee which is non-refundable at the time of booking.

The balance is due 28 days prior to your holiday arrival date. Please note if your booking is made within the 14 days of your arrival date, the full balance will be taken at time of booking.

All payments are non-refundable.

3. Access to Property

During the duration of your stay, you are able to enter, occupy and use The Old Coach House as a Holiday Let. We retain the right to enter The Old Coach House during your stay, providing:

· it is reasonably necessary,

· it is required to fulfil the service of this agreement e.g. complete a changeover of linen and towels, resolve a service issue, etc.

If you stay beyond the checkout time, we reserve the right to instruct you to leave in a manner permitted by Scottish Law. Holiday Lets are subject to statutory legislation. We also reserve the right to impose an additional weekly booking fee.

Access arrangements, key safe code and directions will be provided within one week of your stay.

4. Cancellations, Reservation Issues, Refunds

Please check carefully the dates that you want to book and reserve The Old Coach House prior to making a booking. A 50% non-refundable booking fee is applicable to secure your booking. We will confirm your booking by invoice once we have confirmed that the dates you have selected are available. Your booking will be secured upon receipt of your deposit.

The balance is due 28 days prior to your holiday arrival date. Please note if your booking is made within the 14 days of your arrival date the full balance will be taken at time of booking. The reservation cannot be changed or modified, and we do not provide refunds for payments received.

We recommend that you attain appropriate holiday insurance for your booking that will cover you in the event of cancellation or in the event of a force majeure that prevents you attending.

5. Use of the Property

The Old Coach House, Arrochar is available as a short-term, self-catering holiday let and subject to paragraph 6 of Schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016. The booking agreement provides you with the right to occupy the cottage for the agreed period only for the sole purpose of a holiday purposes and cannot be sub-let.

The property is as described on this website and its use is set out in the Welcome Pack located in the property which you will find on arrival.

· This is a No Smoking property. No smoking is permitted within the property.

· Guests are asked to treat the neighbours and the property with respect while on the premises.

· You must not exceed the maximum number of allowed guests. The accommodation is for a maximum of four guests and two pets.

· Guests must follow all health and safety guidance, fire instructions as provided in the Welcome Pack.

· No fires are to be lit on any part of the grounds or surrounding land. You are within a Forestry area.

· During multi-week stays, we will change your towels and bed linen halfway through your stay. - unless you advise us otherwise, we will attend the property on the usual changeover day (Saturday).

Pets are welcome at £20 per stay per pet, with a max of two dogs. Dogs must always be kept under strict control and must not be left unattended in the property. Please bring your own pet bedding and under no circumstances allow pets on furniture or access to bedrooms. Dog mess must be cleared from outside areas immediately.

We ask that the property is left in a clean and tidy condition and that should any items be accidentally broken or damaged that you undertake to inform us at the time and as required replace or repay.

An excess cleaning charge of £35 may be applied if there is evidence of dogs.

6. Damage to Property or Unreasonable Behaviour

You agree not to cause any damage to the property or its furniture and fixings.

Whether accidental, through neglect or deliberate, all damages must be reported to the owner or property manager and paid for, including additional cleaning that may be required as well as lost booking fees if the damage affects the next or subsequent bookings.

Bookings may be terminated immediately if the owner or property manager receives a complaint from neighbours or public officials e.g. because noise levels are too high or a disturbance is being caused. If unreasonable behaviour, damage to property, the agreement may be terminated, and you will be asked to leave the premises. In such cases, no refund will be given.

A claim by us for damages does not affect your contractual and statutory rights. We maintain the right to take legal action if required to recover the cost of damages.

7. Indemnification.

To the maximum extent permitted by applicable law, you agree to release, indemnify YTC against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

· your breach of these Terms

· your improper use of The Old Coach House

· your breach of any laws, regulations or third-party rights such as intellectual property or privacy rights.

8. Force Majeure

We are not be liable for any delay or failure to perform resulting from abnormal and unforeseeable circumstances outside its reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labour or materials.

We will not be in breach of these Terms, nor our contract with you, nor liable for delay in performing, or failure to perform, any of the obligations under these Terms if such delay or failure result from events, circumstances or causes beyond our reasonable control.

9. Problem Resolution & Complaints

All problems, issues or complaints must first be referred to the Owner or Property Manager. Our contact details are in the Welcome Pack and on the website. These should be raised during your stay to allow for immediate remedial action to be taken to ensure you have the best stay.

Compensation will not be made for complaints raised after the stay has ended as we will have been denied the opportunity of investigating the complaint or issue and allowing us to put matters right during your stay.

Please note we often have departures and arrivals taking place on the same day. In order to avoid anything less than the best arrival experience for subsequent guests, we ask that any damage be reported to us immediately to allow us time to orchestrate repairs or replacements. This opportunity was extended to you in the previous guest booking.

10. Applicable Law and Jurisdiction.

These Terms are governed by and construed in accordance with Scottish law. You agree that any disputes will be handled in a Scottish Court of Law.

11. Privacy Policy

The Old Coach House website is owned by YTC, which is a data controller of your personal data. The data you provide will be used for the sole purpose of arranging a booking at The Old Coach House and collecting payment. We will take care of your personal data and undertake to guarantee its confidentiality and security.

Personal information we collect:

When you visit The Old Coach House website, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the installed cookies on your device. Additionally, as you browse the Site, we may collect information about the individual web pages you view, what websites or search terms referred you to the Site, and how you interact with the Site. Moreover, we might collect the personal data you provide to us (including but not limited to Name, Surname, Address, payment information, etc.) during registration to be able to fulfil the agreement.

Why do we process your data?

Our top priority is customer data security, and, as such, we may process only minimal user data, only as much as it is absolutely necessary to maintain the website and provide the service you seek. Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding website usage. This statistical information is not otherwise aggregated in such a way that it would identify any particular user of the system.

You can visit the website without telling us who you are or revealing any information, by which someone could identify you as a specific, identifiable individual. If, however, you wish to use some of the website’s features, or provide other details by filling a form, you may provide personal data to us, such as your email, first name, last name, city of residence, organization, telephone number. You can choose not to provide us with your personal data, but then you may not be able to book the cottage.
